Terms of Service

1. Acceptance of Terms: These Terms constitute an enforceable electronic contract within the meaning of the Information Technology Act, 2000 between the user ("User", "You") and Bigpay India Private Limited ("Company", "We", "Us"), the legal operator of the Api Partner messaging platform. By registering, accessing, or utilizing Api Partner services, you agree to be legally bound by these Terms of Service. If you disagree with any portion, you must terminate access immediately.

2. Authorized Commercial Use: The service is provided strictly for legitimate transactional messaging, customer engagement, and authorized notifications. Sending unsolicited bulk spam, phishing campaigns, deceptive content, or violating telecommunication regulations (including TRAI/DLT and Meta WhatsApp Commercial Policies) will result in immediate account termination without refund.

3. Channel Provider Rules: Customers acknowledge that third-party messaging networks (Meta/WhatsApp, Telegram, and Telecom Carriers) maintain independent anti-spam heuristics. While Api Partner implements anti-ban throttling and speed pacing, end-user account standing and ban risk remain the responsibility of the account holder.

4. API Keys & Account Security: You are solely responsible for maintaining the confidentiality of your API keys and login credentials. Any API requests signed with your cryptographic keys are deemed authorized by your organization.

5. Limitation of Liability: Under no circumstances shall Bigpay India Private Limited be liable for indirect, incidental, or consequential damages arising from upstream network downtime, carrier failures, or third-party platform policy enforcements.

6. Governing Law & Jurisdiction: Any legal proceeding, dispute, or claim arising between the parties shall be subject to the exclusive jurisdiction of the competent courts situated in Unnao / Lucknow, Uttar Pradesh, India.
